Welcome to Cancun ATVs. These Terms & Conditions govern your use of our website and your booking of tours and activities operated or resold by XPECTATIVE TRAVEL S.R.L. de C.V. (“Cancun ATVs,” “we,” “us”). By booking with us, you agree to these terms.
Who We Are
Cancun ATVs is a travel agency based in Cancún, Quintana Roo, Mexico. We operate our own adventure tours and, as an authorized agency, we also book and resell experiences from major parks and providers in the Riviera Maya. When we resell a third-party experience (such as a park tour), that experience is delivered by the provider under their own operating conditions, which we will share with you.
Bookings
When you book a tour, you provide basic information such as your name, pickup hotel, date, and number of participants. You are responsible for the accuracy of this information. A booking is confirmed once payment (deposit or full) is received and you receive our confirmation.
Prices & Payment
Prices are shown on each tour and may be displayed in USD. Payment is processed securely through Stripe within our WooCommerce checkout, or in cash upon arrival at the activity where that option is offered. We do not store your card details — all card payments are handled directly by Stripe. Some bookings may require a deposit (typically 20%) to confirm your spot, with the balance due as indicated.
Cancellations & Refunds
You may cancel anytime. Refunds, when they apply, are subject to penalties that vary by tour type, activity, and group size. Please review our full Cancellation & Refund Policy for details.
Participant Responsibility & Requirements
Our activities include adventure experiences such as ATV riding, cenote swimming, ziplining, and water activities. Some tours have specific age, health, weight, or physical requirements, stated on each tour page. By booking, you confirm that you and everyone in your party meet the stated requirements and are in suitable health to participate. You must follow all safety instructions and guide directions during the activity.
Assumption of Risk
Adventure activities involve inherent risks, including physical exertion, uneven terrain, water, motorized vehicles, and natural environments. By participating, you acknowledge and voluntarily accept these inherent risks. You agree to participate responsibly, follow all safety briefings, wear provided safety equipment, and not participate under the influence of alcohol or substances. Participants may be required to sign an activity-specific waiver from the operating provider before the activity begins.
Limitation of Liability
To the fullest extent permitted by applicable law, Cancun ATVs and its operators are not liable for injuries, losses, or damages resulting from a participant’s failure to follow safety instructions, misrepresentation of health or eligibility, or the inherent risks of adventure activities voluntarily undertaken. For experiences resold from third-party providers, the operating provider is responsible for the delivery and safety of that experience under their own terms.
Changes & Weather
Activities may be affected by weather, natural conditions, or operational reasons. If an activity must be cancelled or rescheduled by us or the provider for such reasons, we will contact you to reschedule or discuss options.
Website Use
Our website content, branding, images, and text are the property of Cancun ATVs unless otherwise noted, and may not be copied or reused without permission. We aim to keep all information accurate but do not guarantee the website is free of errors.
Governing Law
These terms are governed by the laws of Mexico. Any disputes will be subject to the competent authorities of Cancún, Quintana Roo, Mexico.
