Welcome to CancunATVs.com These Terms and Conditions ("Terms") govern your use of the website cancunatvs.com (the "Site") and your participation in any tours, activities, or services (collectively, the "Services") offered by XPECTATIVE TRAVEL S.R.L. de C.V., doing business as CancunATVs ("The Company," "we," "us," "our").
By accessing the Site, making a reservation, or participating in our Services, you, the user and/or participant ("Participant," "you," "your"), acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. These Terms constitute a binding legal agreement between you and The Company. If you do not agree with any part of these Terms, you must immediately cease using the Site and refrain from booking or participating in our Services.
1. Scope of Services and Website Use
1.1. Description of Services
The Company provides guided adventure tourism experiences in and around Cancun, Mexico. Our Services primarily include, but are not limited to, guided All-Terrain Vehicle (ATV) tours through jungle trails, swimming in natural cenotes, traversing zipline circuits, and horseback riding . Our tours are designed to offer an authentic experience in a natural environment, distinct from artificial theme parks . The specific components, duration, and inclusions of each tour package are detailed on their respective pages on the Site.
1.2. Use of the Site and Right to Modify
The Site is provided for your personal, non-commercial use to gather information and make legitimate reservations. You agree not to use this Site for any speculative, false, or fraudulent purpose. The Company is the sole owner of the Site. We reserve the right, at our sole discretion and without prior notice, to modify, amend, or update the content, pricing, tour itineraries, Services offered, or these Terms at any time. Your continued use of the Site or Services following any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Reservations, Payments, and Confirmation
2.1. Reservation Process
To make a reservation, you must provide true, accurate, current, and complete personal and payment information as prompted by the booking form. A reservation is considered complete and confirmed only when you have received a confirmation number and the corresponding charge has been successfully applied to your selected payment method.[1] By completing your reservation, you expressly authorize The Company to charge your credit card or PayPal account for the total amount of the reserved Services.
2.2. Pricing, Currency, and Exchange Rates Prices for our Services are displayed by default in United States Dollars (USD).
For your convenience, you may choose to view prices and complete your booking in Mexican Pesos (MXN). The final charge to your credit or debit card will be processed in the currency you select at the time of booking. The Company is not responsible for any discrepancies in the charged amount resulting from exchange rate fluctuations, foreign transaction fees, or other charges applied by your financial institution
2.3. Mandatory Fees
Please be advised that a mandatory, non-refundable Park Conservation & Dock Fee of `10USD` per person is required for all tours. This fee is not included in the online booking price and must be paid in cash upon check-in. This fee supports the preservation of the natural ecosystems in which we operate.[4]
2.4. Accepted Payment Methods
We accept payments via Visa, MasterCard, Apple Pay, Google Pay, Link and Stripe through our secure third-party payment gateways.[1]
2.5. Mandatory Check-In & Fraud Prevention Protocol
To protect our customers and prevent fraudulent transactions, The Company adheres to a strict verification policy.
The individual whose name is on the credit or debit card used for the purchase (the "Cardholder") MUST present the physical credit/debit card and a valid, matching government-issued photo identification (e.g., passport, driver's license) at the time of check-in.
Failure to present these two documents will result in the reservation being considered invalid, and participation in the tour will be denied without any possibility of refund.
In the event the Cardholder will not be present at the tour, a clear, legible copy of the front and back of the credit card and a copy of the Cardholder's matching government-issued photo ID must be sent via email to our official contact address at least 24 hours prior to the tour date for verification.[2] This policy is strictly enforced to prevent credit card fraud.
3. Participant Safety, Conduct, and Assumption of Risk
3.1. Acknowledgment of Inherent Risks
By participating in the Services, you acknowledge, understand, and accept that adventure tourism activities, including but not limited to ATV riding, ziplining, swimming in natural cenotes, and horseback riding, are inherently dangerous. These activities involve significant and unavoidable risks, which may include, but are not limited to: falls; collisions with other vehicles, persons, or objects; equipment failure; unpredictable and rugged terrain; variable weather conditions; encounters with native flora and fauna; and other foreseeable and unforeseeable hazards . You understand that such risks can result in property damage, serious physical injury, disability, or death. You voluntarily accept and assume all such risks, both known and unknown, and agree that these risks cannot be eliminated without fundamentally altering the unique character of the activities.
3.2. Health and Physical Requirements
You certify that you are in good physical health and have no medical conditions that would prevent you from safely participating in the Services. It is your sole responsibility to consult with a physician prior to participation if you have any pre-existing medical conditions. You must inform The Company's staff prior to booking of any conditions including, but not limited to, heart problems, back or neck issues, recent surgery, epilepsy, or pregnancy.[4] The Company reserves the absolute right, at its sole discretion, to refuse participation to any individual it deems may pose a safety risk to themselves or others, without refund or recourse.[5]
3.3. Age and Weight Restrictions
The following restrictions are strictly enforced for safety reasons:
ATV Drivers: The minimum age to drive an ATV is 16 years old. While a government-issued driver's license is not required to operate ATVs on our private park trails, all drivers under the age of 18 must have a liability waiver signed by a parent or legal guardian present at check-in .
Ziplines: The maximum weight limit for the zipline activity is 320 lbs (140 kg) . Participants exceeding this limit will not be permitted to engage in the zipline portion of the tour. No partial refunds will be issued.
3.4. Rules of Conduct and Intoxication Policy
Participant safety is our highest priority. You agree to follow the instructions of our guides at all times.
A strict zero-tolerance policy is in effect for alcohol and intoxicating substances. Any individual who is, or appears to be, under the influence of alcohol, illegal drugs, or any other impairing substance will be prohibited from participating in any and all activities. This determination will be made at the sole discretion of our staff. No refund will be issued in such cases .
3.5. Camera and Personal Electronics Policy
To ensure the safety of all participants, your hands must be free at all times during adventure activities. The use of handheld devices, including but not limited to cell phones, "point and shoot" cameras, and DSLR cameras, is strictly prohibited during the ATV, zipline, and other dynamic portions of the tour.[3]
An exception is made for action cameras (e.g., GoPro) ONLY if they are securely fastened with a head mount to a helmet provided by The Company. The use of selfie sticks, chest mounts, wrist mounts, or any other type of mount is expressly forbidden.[3, 4] The Company is not responsible for any lost or damaged personal electronic devices.
3.6. Release of Liability and Indemnification
In consideration for being permitted to participate in the Services, you hereby agree to release, waive, discharge, and hold harmless, XPECTATIVE TRAVEL S.R.L. de C.V., its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and guides (collectively, the "Released Parties") from any and all liabilities, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, whether caused by the negligence of the Released Parties or otherwise, while participating in the Services. This release applies except in cases of gross negligence or willful misconduct proven in a court of competent jurisdiction in Cancun, Quintana Roo.
4. Intellectual Property
4.1. Ownership of Content
All content included on the Site, such as text, graphics, logos, images, video clips, audio clips, and software, is the property of , XPECTATIVE TRAVEL S.R.L. de C.V. or its content suppliers and is protected by Mexican and international copyright and intellectual property laws. The compilation of all content on this Site is the exclusive property of The Company.[1]
4.2. Prohibited Use
The content on this Site may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the prior written permission of The Company. Unauthorized use of any such content is a violation of copyright, trademark, and other applicable laws and could result in criminal or civil penalties.
5. General Provisions
5.1. Governing Law and Jurisdiction
This Agreement and any disputes arising out of or related to the Services or these Terms shall be governed by and construed in accordance with the laws of the State of Quintana Roo, Mexico, without regard to its conflict of law provisions. You irrevocably agree to submit to the exclusive jurisdiction of the competent courts located in Cancun, Quintana Roo, Mexico, for the resolution of any legal matter arising from this Agreement.[3]
5.2. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from the Terms, and the remainder of the Terms shall remain in full force and effect.
5.3. Entire Agreement
These Terms, along with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and The Company concerning your use of the Site and Services, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and The Company.
